Though "I know it when I see it" is widely cited as Stewart's test for "obscenity", he never used the word "obscenity" himself in his short concurrence. He only stated that he knows what fits the "shorthand description" of "hard-core pornography" when he sees it. Stewart's "I know it when I see it" standard was praised as "realistic and gallant" and an example of candor. It has also been critiqued as being potentially fallacious, due to individualistic arbitrariness. "This simple phrase, embedded in a plurality opinion, carries with it many of the conflicts and inconsistencies that continue to plague American obscenity law.

The federal government and the states have long been permitted to limit obscenity or pornography. While the Supreme Court has generally refused to give obscenity any protection under the First Amendment, pornography is subject to little regulation. However, the definitions of obscenity and pornography have changed over time. In Rosen v. United States (1896), the Supreme Court adopted the same obscenity standard as had been articulated in a famous British case, Regina v. Hicklin (1868). The Hicklin test defined material as obscene if it tended "to deprave or corrupt those whose minds are open to such immoral influences, and into whose hands a publication of this sort may fall".

JM (Jeff Mike) Productions is a hardcore pornographic film production and distribution company based in Chatsworth, California. The studio's material is controversial, with its films often featuring erotic humiliation and rough sex. JM has faced legal charges of obscenity in the U.S., and the studio has also won many adult industry awards. The company was founded by Jeff Steward. On 21 May 2001, the company's offices were raided by twenty officers from the LAPD. They confiscated several bukkake-themed videos. In response, Steward stated: "Some guy swims in feces on MTV, and that's OK? But for a girl to swallow eighty loads of cum is obscene? I don't think so."

The magazine was published monthly and featured photographs of nude women, and articles on fashion, sport, consumer goods and public figures. Playmen's use of "tasteful" nude photos is classified as softcore in contrast to hardcore pornographic magazines. It ceased publication in 2001. During a running battle with the Italian police, the magazine reached a circulation of 450,000 within four years of its 1967 inception. It sold at about the equivalent of a US dollar per copy. Playmen was initially an imitator of Playboy magazine, although the first Girl of the Month, Brigitte Bardot, held her hands to cover her breasts.
