Free Speech Coalition

The Court extended Ferber to mere possession of child pornography in Osborne v. Ohio,. Before 1996, Congress defined child pornography with reference to the Ferber standard. In passing the Child Pornography Prevention Act of 1996, Congress added the two categories of speech challenged in this case to its definition of child pornography.

Adam4Adam

Gay & Lesbian News reports that Adam4Adam and similar sites may soon come under an expanded interpretation of 18 U.S.C. 2257, the Child Protection and Obscenity Enforcement Act and wrote: anyone with a sexually explicit picture on a site like Adam4Adam.com could be considered a secondary producer if the new regulations go into effect, and would be subject to the same type of requirements that the adult Web sites would be under. If successfully applied, these regulations would mean that Adam4Adam and similar companies would have to keep records proving that individuals appearing in photographs or videos are over the age of 18.

Rod Harrel

The 70-minute video didn't even make it through one cablecast when the operators stopped the tape before the end because three viewers called to complain. The story featured male nudity and one of the comments claimed that Multnomah Cable Access was showing pornography and obscene language. The legal department at M.C.A. felt that Jack probably violated Oregon's very liberal obscenity laws. Harrel took his case to the press and in short order, Peter Farrell, the Oregonian's television critic, penned a column. "Most of the nudity occurs in connection with discussion about sexual politics and values, which would seem to protect it from even fairly narrow views on obscenity," he wrote.

The Government can continue to protect children from pornography on the Internet through vigorous enforcement of existing laws criminalizing obscenity and child pornography. [...] As we learned at the hearing, there is also a compelling need for public educations about the benefits and dangers of this new medium, and the Government can fill that role as well. In my view, our action today should only mean that Government's permissible supervision of Internet contents stops at the traditional line of unprotected speech. [...]
